Terms of use

These terms govern your use of the Foyer website and web application. By creating an account you accept them. If you use Foyer on behalf of a company, you confirm that you are authorised to bind it.

Foyer is a marketplace connecting three sides: companies that list products, creators who market them for a commission, and customers who buy.

Contracts of sale are concluded between the selling company and the customer. Foyer is not a party to them, does not own the goods, and is not the seller. Responsibility for a product’s description, legality, quality, delivery, warranty and returns lies with the company that listed it.

You must give accurate registration details and keep your credentials confidential. You are responsible for what happens under your account. One person or entity may hold one account per role; accounts may not be sold or transferred.

You must be at least 18 years old to register as a creator or a company.

Companies are responsible for their listings being accurate and lawful, for holding the rights to the images and text they upload, for pricing and stated availability, and for fulfilling orders, handling returns and honouring statutory warranty rights.

By launching a campaign, a company authorises participating creators to promote the listed products using the material it supplies, and undertakes to pay the commission it advertised on every attributed sale.

Creators promote products using the tracking link Foyer issues. Promotion must be honest, must not misrepresent a product, and must be disclosed as advertising wherever the applicable law or platform rules require it.

Commission is earned on completed, attributed sales and is subject to reversal if the underlying order is cancelled, refunded or found to be fraudulent. Buying through your own link to generate commission, and any other manipulation of attribution, is prohibited.

Customers buy from the listing company on that company’s terms. Questions about an order — delivery, defects, returns — go to that company first. Foyer will help mediate where it reasonably can.

Foyer’s fee and each campaign’s commission rate are shown before you commit to anything. All figures are in Swiss francs and, where applicable, include VAT.

Payment processing and payouts are not yet live. Until they are, no fee is charged and no commission is paid out, whatever a preview interface may display.

You may not use Foyer to offer or promote anything unlawful, counterfeit, dangerous or age-restricted beyond what the platform supports; to infringe intellectual property; to harass or defraud anyone; to send spam; or to attempt to breach, overload or reverse-engineer the platform’s technical protections.

Foyer may suspend or terminate an account that breaches these terms, and will say why unless the law prevents it.

You keep ownership of everything you upload. You grant Foyer a non-exclusive, worldwide, royalty-free licence to host, display and distribute it as far as operating and promoting the platform requires. That licence ends when you delete the content, except for copies retained in backups for a limited period.

Foyer aims for a reliable service but does not guarantee uninterrupted availability. Maintenance, updates and faults may cause downtime. Features described as in development or coming soon are not committed release promises.

To the extent the law permits, Foyer’s liability is limited to intent and gross negligence. Foyer is not liable for indirect or consequential loss, lost profit, or loss arising from a contract between a company and a customer to which Foyer is not a party. Mandatory statutory liability, including for personal injury, is unaffected.

You may delete your account at any time from the dashboard. Foyer may terminate with reasonable notice, or immediately for a serious breach. Obligations already incurred — an unfulfilled order, a commission owed — survive termination.

Foyer may amend these terms. Registered users will be told by email at least thirty days before a material change takes effect. Continuing to use Foyer after that date means accepting the new version.

Swiss law applies, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction is stated in the imprint. Mandatory places of jurisdiction for consumers are unaffected.
